Terms of Service
These Terms of Service govern your access to and use of the TerraBog Analytics platform. Last updated: March 25, 2026. Effective: April 1, 2026.

1. Acceptance of Terms
By accessing or using the TerraBog Analytics platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are entering into these Terms on behalf of a company or other legal entity ("Customer"), you represent and warrant that you have the authority to bind such entity to these Terms, in which case "you" or "your" shall refer to such entity. If you do not have such authority, or if you do not agree to these Terms, you may not access or use the Service. These Terms, together with our Privacy Policy (terraboganalytics.com/privacy), Data Processing Agreement (terraboganalytics.com/dpa), any applicable Order Form, and any plan-specific terms displayed at the time of purchase, constitute the entire agreement between you and TerraBog Analytics, Inc. ("TerraBog," "we," "us," or "our") with respect to the Service. In the event of a conflict between these Terms and an executed Order Form, the Order Form shall control.
2. Description of the Service
TerraBog Analytics is a multi-tenant intelligent data analytics platform for e-commerce businesses. The Service includes, but is not limited to: • Data ingestion via file upload and 27 supported connectors (including Shopify, WooCommerce, Amazon Seller Central, Stripe, QuickBooks, Google Analytics, and others) • Automated data pipeline processing including validation, cleaning, deduplication, normalization, PII detection, and canonicalization • Data warehousing in Google BigQuery with dbt-powered transformations producing analytics-ready mart tables • AI-powered insights and forecasting via Claude AI integration • Machine learning scoring via BigQuery ML (customer segmentation, revenue forecasting, fraud detection) • Data enrichment from public sources including FRED (Federal Reserve Economic Data), U.S. Census Bureau, and Statistics Canada • Dashboard analytics, reporting, and data visualization • Outbound integrations (e.g., HubSpot CRM sync) • Team management, role-based access control, and audit logging TerraBog reserves the right to modify, update, or discontinue features of the Service with reasonable notice. Material changes to core functionality will be communicated at least 30 days in advance via email and in-product notification.
3. Accounts, Access, and Authentication
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify TerraBog immediately of any unauthorized use of your account. Authentication is provided via email/password with JWT session tokens, Google OAuth, GitHub OAuth, or Enterprise SSO (Azure AD, Okta) depending on your plan. Enterprise customers may configure SCIM 2.0 provisioning for automated user lifecycle management, MFA enforcement (TOTP), and IP allowlist restrictions. Each seat license entitles one named individual to use the Service. You may not share account credentials between users. TerraBog reserves the right to suspend accounts that show evidence of credential sharing or that exceed the seat count specified in your subscription. You are responsible for ensuring that all users within your organization comply with these Terms. TerraBog is not liable for any loss or damage arising from your failure to protect your account credentials or to configure appropriate access controls.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to: • Use the Service to store, transmit, or process any data that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable • Attempt to gain unauthorized access to any portion or feature of the Service, or to any other systems or networks connected to the Service, including other tenants' data • Circumvent, disable, or interfere with tenant isolation controls, row-level security policies, or any other security feature of the Service • Use any automated means (bots, scrapers, crawlers) to access the Service for any purpose without our express written permission • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service, including dbt models, ML pipelines, or API logic • Remove, alter, or obscure any proprietary notices, trademarks, or labels on the Service • Use the Service to store or transmit malicious code, viruses, or other harmful content • Resell, sublicense, time-share, or transfer your rights to use the Service to any third party without prior written consent from TerraBog • Use the Service in a manner that exceeds reasonable usage thresholds or that degrades service quality for other customers TerraBog reserves the right to suspend or terminate access for violations of this section without prior notice. We will make reasonable efforts to notify you of the violation and provide an opportunity to cure where practicable.
5. Customer Data and Intellectual Property
You retain all rights, title, and interest in and to the data you upload, connect, or create within the Service ("Customer Data"). TerraBog does not claim ownership of Customer Data. By using the Service, you grant TerraBog a limited, worldwide, non-exclusive, royalty-free license to host, store, process, transform, transmit, and display your Customer Data solely to the extent necessary to provide the Service. This license includes the right to process Customer Data through our data pipeline (ingestion, validation, cleaning, canonicalization, dbt transformation, and ML scoring) and to store results in BigQuery and Cloud SQL. TerraBog and its licensors retain all rights, title, and interest in and to the Service, including all software, algorithms, dbt models, ML models, user interface designs, documentation, and other intellectual property. These Terms do not grant you any rights to use TerraBog's trademarks, logos, or brand features without prior written consent. Aggregated, anonymized, and de-identified usage statistics (e.g., feature adoption rates, pipeline throughput metrics) may be used by TerraBog to improve the Service. Such statistics will never contain Customer Data or be attributable to any individual customer. Any feedback, suggestions, or improvement ideas you voluntarily provide about the Service may be used by TerraBog without restriction or obligation to you.
6. Billing, Payment, and Plans
Subscription fees are billed in advance on a monthly or annual basis, as selected at time of purchase. All fees are quoted and payable in U.S. dollars. Payment is processed securely by Stripe; TerraBog does not store credit card numbers or payment credentials on its systems. TerraBog offers the following plan tiers: Starter, Growth, and Enterprise. Each plan specifies included seat counts, data retention periods, connector limits, and feature availability. Plan details and current pricing are available at terraboganalytics.com/pricing. TerraBog will provide at least 30 days advance written notice of any price changes for existing subscriptions. Price increases will not apply until the start of your next billing period following the notice period. Continued use of the Service after a price change takes effect constitutes acceptance of the new pricing. If your payment method fails and you do not update your billing information within 14 days, TerraBog reserves the right to suspend your account. Data is retained for 30 days following suspension before permanent deletion. We will send payment failure reminders at 3, 7, and 14 days. Annual subscriptions may be cancelled within 30 days of the start of the current subscription period for a pro-rated refund. After 30 days, annual subscriptions are non-refundable for the remainder of the current term. Monthly subscriptions may be cancelled at any time and will remain active through the end of the current billing period.
7. Service Levels and Support
TerraBog targets 99.9% monthly uptime for the Service, measured as the percentage of minutes in a calendar month during which the core platform (API, dashboard, and data pipeline) is available. Scheduled maintenance windows, which are communicated at least 48 hours in advance, are excluded from uptime calculations. If monthly uptime falls below 99.9%, affected Enterprise customers with an executed SLA addendum are eligible for service credits as specified in their Order Form. Support is provided via email (support@terrabog.com) during business hours (9:00 AM -- 6:00 PM PT, Monday through Friday) for Starter and Growth plans. Enterprise customers receive priority support with a 4-hour initial response time for critical issues (Severity 1) and access to a dedicated Customer Success Manager. TerraBog publishes real-time service status at status.terraboganalytics.com and will notify affected customers via email for any incident exceeding 15 minutes of downtime.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TERRABOG'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL FEES ACTUALLY PAID BY YOU TO TERRABOG IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IN NO EVENT WILL TERRABOG BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF TERRABOG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE LIMITATIONS IN THIS SECTION DO NOT APPLY TO: (A) TERRABOG'S INDEMNIFICATION OBLIGATIONS; (B) EITHER PARTY'S BREACH OF CONFIDENTIALITY OBLIGATIONS; OR (C) YOUR PAYMENT OBLIGATIONS UNDER THESE TERMS. Some jurisdictions do not allow the exclusion or limitation of certain types of damages. In such jurisdictions, TerraBog's liability shall be limited to the greatest extent permitted by applicable law.
9. Termination
You may cancel your subscription at any time through the Billing section of the Settings panel or by contacting support at support@terrabog.com. For monthly subscriptions, cancellation takes effect at the end of the current billing period. For annual subscriptions, see Section 6 regarding refund eligibility. TerraBog may terminate or suspend your account immediately, without prior notice or liability, if: (a) you materially breach these Terms and fail to cure such breach within 15 days of written notice; (b) you fail to pay any amounts due within 30 days of the due date; (c) you become insolvent, file for bankruptcy, or make an assignment for the benefit of creditors; or (d) continued provision of the Service to you would violate applicable law. Upon termination or expiration, your right to use the Service will immediately cease. TerraBog will retain your Customer Data for 30 days following termination to allow for data export via the platform or API. After the 30-day export window, all Customer Data will be permanently and irreversibly deleted from BigQuery, Cloud SQL, and GCS. Account metadata and audit logs may be retained for an additional period as required by law or for legitimate compliance purposes. Sections 5 (Customer Data and Intellectual Property), 8 (Limitation of Liability), 10 (Governing Law), and any accrued payment obligations shall survive termination of these Terms.
10. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall first be submitted to good-faith negotiation between the parties for a period of 30 days. If the dispute is not resolved through negotiation, it shall be resolved exclusively in the state and federal courts located in San Francisco County, California, and each party consents to the personal jurisdiction and venue of such courts. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or confidential information.
